Employee App Terms of Service
By tapping "I Agree," you confirm that you have read, understood, and accept these Terms, and that you consent to the location collection described in Section 4. Your acceptance (your name, the date, the time, and the version) is recorded and stored by Oasis Management Inc.
1.Who this applies to
Every employee, contractor, or crew member issued a login to the app, in any field role. Nothing here changes your employment status, pay, or terms of employment.
2.Your account
You sign in with your phone number and a code we text you, or with a passkey once you set one up. A passkey is unlocked by your phone's own Face ID or fingerprint; that never leaves your phone and never reaches us. Oasis Management Inc. stores no biometric data of any kind: no fingerprints, no face scans, no voice prints. Some office accounts sign in with an email address and password instead. Keep your account to yourself; you are responsible for activity on it. Tell the office at once if your phone is lost or your account is used by someone else.
3.What the app is for
Recording your shift punches; showing and accepting assigned jobs; submitting photos, before/after videos, notes, and receipts as proof of work; making requests; messaging coworkers and the office (a message you read may be automatically translated into your app language, shown above the original, and an automated check screens each message before it sends for abuse aimed at a coworker — a flagged message is blocked and never sent, and no record of a blocked attempt is kept); and reviewing and electronically signing company policies.
4.Location data (GPS), read carefully
The app records your device's location at specific moments you use it during your workday (when you punch in, change your work activity, punch out, confirm you are on a job site, and submit work) and continuously in the background, about once every five minutes, for as long as you remain punched in. Background recording starts the moment you punch in and stops when you punch out — including for lunch or any other break. We do not record background location when you are off the clock. That is not just a promise about what we choose to do: our server refuses a background location that arrives outside a punched-in session, on every route that can send one, so it holds even if your phone loses signal, the app is force-closed, or a delayed reading arrives late. The other moments above are recorded whenever you use those features, whether or not you are punched in. The background stream runs in the installed app; in a phone web browser it does not run while the app is in the background. If you forget to punch out, the app still counts you as punched in and keeps recording your location, including after you have gone home, until you or the office punches you out — except that background recording stops on its own once an open shift passes 12 hours, because no real shift runs that long. Your punch record still needs correcting; tell the office.
4a.Your phone
If you use your own phone for work, all of this happens on your personal device. The company does not take your phone or read anything else on it; what it collects is described here.
4b.What is stored with each location
The coordinates, how accurate the fix was, the date and time, information about the device you used, the network address the app connected from, and, when the app knows which job you are on, how far you were from that job's address and whether that counted as on site. We also keep a record of each time you turn location permission off and on, and the office is alerted if your location goes stale while you are punched in (for example, if the app is closed from your phone's recent-apps list).
4c.What we use it for
(a) Confirming you are at the correct assigned job site; (b) confirming you are traveling to the correct assigned job site between punches; (c) supporting accurate timekeeping and payroll, since your pay is based on verified attendance; (d) alerting the office when you appear to leave a job site while you are punched in; and (e) producing travel information about your workday for the office, including your estimated speed between recorded points, whether your route was direct, and stops that don't match an assigned job. We use that to support safe driving in company vehicles and to check fuel reimbursements and reported hours. These are estimates from a reading every five minutes, not measurements, and they are flags for a person to review rather than findings. They come from your phone, not from the vehicle, so a stop at your own home can appear as a stop that doesn't match a job.
4d.Who can see it
Company administrators, the office manager, and anyone else granted access to the hours screens can see any worker's location, including the full minute-by-minute timeline of a day. On the live map and dispatch board a manager sees the people who report to them; the day timeline is not narrowed that way. HR and payroll see it for timesheets and for resolving disputes. You cannot currently see your own location history in the app; ask the office and we will show it to you.
4e.How long we keep it
Your coordinates are deleted after 90 days, by a job that runs every night. Background pings are deleted outright. Punches, activity changes, submissions, work videos, and receipts keep the record that they happened, because that is payroll and job proof, but the coordinates are stripped off them at the same 90 days. Two things survive that cleanup and you should know it: whether a punch counted as being at the assigned job (a yes or no, not a place), and the device and network information stored with the record.
4f.Permission and refusals
Confirming you are on a job site requires GPS and is refused unless your phone reports you within about a tenth of a mile of that job's address; a confirmation we cannot verify is refused rather than accepted. Punching in and out is not distance-checked, but it is blocked once your phone has told us you denied location permission, and you must grant it again before you can punch. A punch still records with no coordinates when your phone simply cannot get a fix. By agreeing, you consent to this collection as a condition of using the app for work. You may revoke location permission in your phone settings, but then you will be unable to punch or confirm a job site. Tell your manager so other arrangements can be made.
5.Photos, videos, notes, receipts
What you submit becomes a business record used for verification, quality control, billing, and recordkeeping. Video is kept indefinitely as part of the job record. Walkthrough video is always recorded without audio (Massachusetts all-party-consent law, M.G.L. c. 272 § 99). The app strips any audio track before the clip is ever stored, on every video, everywhere, not just inside a unit.
6.Accurate reporting
Punch truthfully and mark a job complete only when the work is actually done. Falsifying records may lead to discipline up to termination.
7.Company policies
These Terms are in addition to all other Oasis policies, including the Employee Manual (which includes the Drug & Alcohol Policy). Acknowledging a policy in the app has the same effect as signing paper.
8.Electronic signatures
Your on-device tap or signature is your legal signature, to the fullest extent permitted by the ESIGN Act and Massachusetts UETA. We record who signed, what version, and when.
9.Prohibited use
Do not share your login; submit false or altered records; use the app for anything unrelated to your work; or bypass its security or location features.
10.Changes
We may update these Terms; a material change asks you to review and re-accept before continuing. Your acceptance history is kept.
11.The app and your pay
The app is how your time is recorded, but an app problem never costs you pay for time you actually worked. If the app is down, a punch fails, or a record looks wrong, tell your manager the same day and the record will be corrected. Your right to be paid for hours worked comes from the law and does not depend on the app working.
12.No promise of uninterrupted service
The app is a work tool provided as it is and as available. We work to keep it running, but we do not promise it will be uninterrupted or error-free, and we may change, suspend, or remove features or access, including when your work with us ends. If something in it is wrong, report it and we will fix the record (see Section 11).
13.What these Terms do not limit
Nothing in these Terms waives or limits any right you have under wage-and-hour, workers' compensation, anti-discrimination, or any other employment law, and nothing in them is an agreement to arbitrate. To the fullest extent the law allows, Oasis Management Inc is not liable for indirect or incidental losses from use of the app itself, such as carrier data charges on your own phone; that limitation never applies to your wages or your rights as an employee.
14.App stores
The app is distributed through the Apple App Store and Google Play. Apple and Google are not parties to these Terms, have no obligation to maintain or support the app, and are not responsible for it or for any claim relating to it. To the extent their own terms require, Apple and its subsidiaries are third-party beneficiaries of this section and may enforce it against you as such.
15.Severability
If any part of these Terms is found unenforceable, the rest remains in effect.
16.Governing law
Massachusetts.
